COVID-19 Public Health Emergency Extended

The HHS Secretary Becerra has extended the COVID-19 Public Health Emergency by another 90 days.  The PHE was set to expire yesterday.  The new 90-day extension is effective as of yesterday, October 13, 2022, and will run until January 11, 2023, unless rescinded earlier. As noted in my email below from May 12, 2022, Secretary Becerra and the Biden Administration have committed to providing at least 60-days’ notice before any expiration or termination of the PHE.  Thus, if the Secretary does not plan to renew the PHE on January 11, 2023, he would need to provide notice on or before November 12, 2022.
